Motorcycle safety comes first
ArcRoute is a navigation aid, not a substitute for your judgment, road signs, traffic law, weather awareness or a safe riding plan.
Set up the route before moving. Never hold, read or interact with a device while riding unless the interaction is lawful and can be performed safely through an appropriate hands-free interface.
By starting a subscription, creating an account or using the Service, you agree to these Terms. Mandatory consumer rights remain unaffected.

1. About ArcRoute and these Terms
ArcRoute is provided by Petr Novák, an individual entrepreneur registered in the Czech Republic under Business ID No. 03741842, with registered office at Marie Podvalové 1041/8, 196 00 Praha-Čakovice, Czech Republic (“ArcRoute”, “we”, “us” or “our”). These Terms of Service (the “Terms”) govern your use of the ArcRoute iOS application (the “App”), your ArcRoute account and the navigation, route-planning, ride-recording, synchronisation and related online functions made available through the App (together, the “Service”).
These Terms are a contract between you and ArcRoute. They supplement, and do not replace, the Apple terms that apply to your use of the App Store and your Apple Account. If you do not agree to these Terms, do not create an account, start a subscription or use the Service.
Your licence to install and use the iOS App is also governed by the Apple Standard End User License Agreement. These Terms govern the ArcRoute account, subscription and hosted Service. Mandatory law prevails over any inconsistent provision.
2. Eligibility and contract formation
The Service is intended for individuals aged 16 or older.
If you are 16 or 17, you may use the Service only with the approval of a parent or legal guardian. By using the Service, you confirm that you meet this age requirement and, where applicable, have obtained that approval.
By starting a subscription, creating an account or using the Service, you confirm that you have legal capacity to enter into this contract or that any approval required under applicable law has been obtained. Nothing in these Terms limits any protection that applies to minors under the law of their country of residence.
Riding a motorcycle remains subject to the licence, insurance, registration, equipment and traffic rules that apply where you ride.
A contract for ArcRoute Pro is formed when Apple confirms your subscription purchase after these Terms have been made available to you. These Terms also govern the ArcRoute account and Service made available under that subscription. Viewing the first-run introduction or paywall does not create a separate contract for a free service. The version of the Terms presented or linked when you subscribe applies to that contract, subject to later valid changes under Section 17.
The contract language is English. We may provide translations or local consumer information. A translation does not reduce any mandatory rights that apply in your country of residence; where mandatory law requires a local-language version or interpretation to prevail, that law applies.
3. The Service and technical requirements
ArcRoute provides tools for planning motorcycle routes, viewing map information, following navigation instructions, importing routes, recording rides, calculating ride statistics, maintaining a personal ride heatmap and synchronising selected data across signed-in devices. The ArcRoute Pro feature set available at the time of purchase is described in the App. Features may evolve only in accordance with Sections 12 and 13, these Terms and applicable mandatory consumer law.
To use the Service, you need a compatible Apple device, a supported version of iOS, an Apple Account where required, working location services and sufficient battery power. Internet access is required for functions such as sign-in, place search, route calculation, map loading, cloud synchronisation, subscription verification and some updates. Some functions may be unavailable when connectivity is poor or absent.
Compatibility, interoperability, geographic coverage and current system requirements are described in the App Store listing or in the App. Map coverage, route availability and third-party data may differ by country and may change. Features described as beta, preview, experimental or coming soon are not part of the paid commitment until they are released as generally available features.
4. Account and security
An ArcRoute account is required for cloud synchronisation and other account-based features. The current sign-in method is Sign in with Apple. You must provide accurate information available through that process and keep control of your Apple Account and device.

Do not share access to your ArcRoute account or permit another person to use it in a way that breaches these Terms.

Notify us promptly at support@arcroute.app if you believe your account or device has been compromised.

You are responsible for activity performed through your account unless it results from our failure to use reasonable security measures.

You may use only one account for yourself unless we expressly permit otherwise.
5. ArcRoute Pro subscriptions
5.1 Plans and pricing
ArcRoute offers auto-renewable monthly and annual ArcRoute Pro subscriptions. Both plans provide access to the Pro feature set described in the App.
The available plan, billing period, final price, currency and applicable taxes are displayed in the App and in Apple’s purchase confirmation interface before you confirm the purchase. Prices may differ by country or region. The price shown by Apple at the time of purchase is the price applicable to that subscription period.
5.2 Seven-day free trial
Eligible new subscribers may be offered a seven-day free trial. Apple determines eligibility for introductory offers, including by reference to prior subscriptions within the relevant subscription group. If you are not eligible, Apple will show the standard price before you confirm the purchase.
Unless you cancel before the trial ends, the subscription automatically converts to the selected paid monthly or annual plan and Apple charges the payment method associated with your Apple Account. Cancellation of a free trial is separate from any statutory withdrawal right described in Section 6.
5.3 Renewal, billing and cancellation
Your subscription renews automatically for successive periods of the same duration until cancelled. Apple processes the purchase, renewal, tax calculation and payment. ArcRoute does not receive your payment-card details.

You can view, manage or cancel the subscription in your Apple Account subscription settings.

Cancel before the renewal is processed to avoid the next charge. Access normally continues until the end of the paid period, subject to Apple’s rules.

Deleting your ArcRoute account, signing out or uninstalling the App does not cancel the Apple subscription.

If Apple refunds, revokes or otherwise ends the entitlement, Pro access may end when StoreKit reports that change.
Apple provides subscription management and refund tools through your Apple Account and Apple’s purchase-support process.
5.4 Price or plan changes
We may change subscription prices or plan structure for valid commercial, technical or legal reasons. Changes apply prospectively and are communicated through Apple or the App as required by law. Where Apple or applicable law requires your consent to a price increase, the subscription will not renew at the increased price without that consent. You may cancel before the change takes effect.
5.5 Refunds
Because Apple controls App Store billing, refund requests are normally submitted through Apple’s applicable process. We will provide reasonable assistance where the issue concerns the ArcRoute Service. Nothing in this Section excludes a mandatory remedy, refund or other right you may have against ArcRoute under applicable consumer law.
6. Statutory withdrawal and consumer rights
Free-trial cancellation is not the same as statutory withdrawal
Cancelling the seven-day trial prevents an automatic charge if completed in time. Consumers may separately have a statutory right to withdraw from a distance contract, usually within 14 days, depending on the applicable law and the circumstances of supply.
If you are a consumer in the European Economic Area or another jurisdiction that grants a withdrawal right, you may withdraw from the relevant distance contract within the statutory period without giving a reason, unless a lawful exception applies. The usual EEA period is 14 days from conclusion of the contract.
To exercise the right, send us a clear statement at support@arcroute.app or use the model form in Schedule 1. Where Apple controls the billing transaction, we may also direct or assist you to complete the refund through Apple. It is sufficient to send the withdrawal communication before the period expires.
If you expressly request that a service begin during the withdrawal period, applicable law may permit a proportionate charge for the service supplied before withdrawal. Any loss of a withdrawal right for digital content applies only where all conditions required by mandatory law have been satisfied. These Terms do not create a broader waiver of withdrawal rights.
In addition to withdrawal rights, consumers have mandatory rights where a digital service does not conform to the contract. Section 12 summarises how to contact us and the remedies that may apply. The summary does not limit those rights.
7. Licence and intellectual property
The App, Service, branding, software, interface, design, documentation and non-user content are owned by ArcRoute or its licensors and are protected by intellectual-property laws. Your licence to the iOS App is governed by the Apple Standard EULA. We grant you a personal, limited, non-exclusive, non-transferable right to access and use the hosted Service for lawful, personal, non-commercial purposes while your account and any required subscription remain active.
You may not copy, sell, sublicense, rent, distribute, publicly display, circumvent access controls, interfere with security, scrape the Service at scale, or reverse engineer the App except to the limited extent that mandatory law expressly permits despite this restriction. Apple and its subsidiaries are third-party beneficiaries of the App licence to the extent stated in the Apple Standard EULA.
8. Your routes, rides and other content
You retain your rights in routes, recorded rides, imported GPX files, route names, notes, profile images and other content you submit or create through the Service (“User Content”). You are responsible for ensuring that your User Content is lawful and that you have the rights needed to upload or use it.
You grant ArcRoute a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, convert, process, back up and display your User Content only as reasonably necessary to operate, secure, synchronise, support and improve the Service for you, including route calculation, map matching, ride statistics and your personal heatmap. This licence ends when the content is deleted from active systems, except for limited residual backup retention and legal obligations described in the Privacy Notice.
ArcRoute does not claim ownership of your User Content and does not make your rides or heatmap public unless a separate sharing feature is offered and you choose to use it. Before deleting your account, request or create an export of any content you want to keep. Some content may not be recoverable after deletion.
9. Acceptable use
You must use the Service lawfully and in accordance with these Terms. In particular, you must not:

use the Service while operating a vehicle in an unlawful or unsafe manner;

use ArcRoute to plan, encourage or carry out trespass, dangerous riding, racing on public roads, evasion of law enforcement or other unlawful activity;

upload malware, abusive content, content that infringes another person’s rights, or data that you are not authorised to process;
-
attempt to obtain another user’s data, bypass account controls, probe the Service for vulnerabilities without written authorisation, or disrupt the Service;
-
use automated methods to extract maps, search results, route data or other protected content except through functionality we expressly provide;
-
misrepresent an affiliation with ArcRoute or use the Service to provide a competing hosted service without permission.
10. Motorcycle safety and navigation limitations
Read this section before every ride
A navigation instruction is never an instruction to ride where it is unlawful, closed, unsafe, unsuitable for your motorcycle or beyond your ability. The real road environment always takes priority.
10.1 Rider responsibility
You are solely responsible for controlling the motorcycle, observing traffic law, maintaining a safe speed and distance, wearing appropriate protective equipment, assessing your skills and fatigue, and deciding whether a route or manoeuvre is safe. Set up and review the route before moving. Pull over safely and lawfully before interacting with the App.
10.2 Route characteristics
Curvy, scenic, adventurous or similar routing preferences are intended to influence route character. They do not identify the safest, easiest, shortest, fastest or most suitable route. A suggested road may be narrow, steep, unpaved, damaged, seasonally restricted, private, subject to local access rules, unsuitable for a particular motorcycle, affected by construction or temporarily closed.
10.3 Data and device limitations
Maps, search results, speed limits, closures, road classifications, surface information, manoeuvres and estimated times may be incomplete, delayed or wrong. GPS can drift or fail, especially in tunnels, forests, cities or poor weather. Mobile networks, third-party services, device sensors, battery, mounting, overheating and software faults can affect operation. You must verify critical information against signs, official notices and actual conditions.
10.4 Imported and previously recorded routes
An imported, saved or previously ridden route is not guaranteed to remain legal, open or safe. Conditions may change after it was created. Review the route and current official information before riding it.
10.5 No emergency or safety-of-life use
ArcRoute is not an emergency service, collision-warning system, medical device or safety-of-life system. Do not rely on it to contact emergency services, locate a missing person, detect hazards or prevent an accident. Use local emergency numbers and official safety services when needed.
These safety warnings allocate responsibility for riding decisions and warn about foreseeable limitations. They do not exclude liability that cannot lawfully be excluded under Section 15.
11. Third-party services and map data
The Service relies on third-party platforms and data, including Apple services, Mapbox services and map data derived from OpenStreetMap contributors. Third-party services may have their own terms and privacy notices and may change, limit or discontinue functionality outside our reasonable control.
Map and attribution information: Mapbox and OpenStreetMap contributors. ArcRoute does not guarantee the completeness or accuracy of third-party data, but we remain responsible for our own obligations under applicable law.
12. Support, updates and conformity
For support, complaints or a suspected defect, email support@arcroute.app and describe the issue, the affected function, your device model, iOS version and App version. Do not send full ride histories or other sensitive data unless requested and necessary for the support case.
We will provide updates, including security updates, that are necessary to keep the Service in conformity for the period required by the contract and applicable law. You should install notified updates within a reasonable time. If you fail to install an update after we clearly explain its availability and consequences, remedies may be affected only to the extent permitted by law and only where the defect results from that failure.
Where the Service does not conform to the contract, eligible consumers may have the right to have it brought into conformity within a reasonable time and without significant inconvenience, or, where statutory conditions are met, to receive a proportionate price reduction or terminate the affected contract. These remedies are subject to mandatory law and do not replace any more favourable local right.
13. Availability and changes to the Service
We aim to keep the Service available but do not promise uninterrupted operation. Maintenance, security incidents, internet or cloud failures, Apple or mapping-platform changes, force majeure, legal requirements and other events may cause interruption. We will use reasonable care to restore material functions.
We may change the Service for a valid reason, including to improve performance or safety, address security or abuse, comply with law, adapt to Apple or third-party platform changes, maintain technical compatibility, replace an unavailable supplier, or develop features. Changes will not impose an additional charge within an already-paid period unless you expressly agree.
If a change negatively affects your access to or use of a continuously supplied digital service more than minimally, we will provide clear advance notice on a durable medium where required, explain the change and its timing, and inform you of any right to terminate without charge. Urgent security or legal changes may take effect sooner, with notice as soon as reasonably possible.
If we discontinue a material paid Service, we will give reasonable notice where possible and provide any remedy required by law. Subscription cancellation or refunds that must be processed through Apple will follow the applicable App Store process.
14. Suspension, termination and account deletion
You may stop using the Service at any time, cancel the subscription through Apple and delete your ArcRoute account through the in-app account-deletion function. These are separate actions: deleting the ArcRoute account does not cancel the Apple subscription, and cancelling the subscription does not automatically delete the ArcRoute account or User Content.
We may suspend or terminate access where reasonably necessary because of a serious or repeated breach of these Terms, non-payment reported by Apple, fraud, a security risk, unlawful use, a legal requirement or discontinuation of the Service. Where appropriate and lawful, we will give notice and an opportunity to remedy the issue before termination. Immediate action may be taken for urgent security, safety or legal reasons.
On termination, your right to use the affected Service ends. Provisions that by their nature should survive, including intellectual-property, accrued payment obligations, liability, dispute and general provisions, continue to apply. Account deletion is irreversible once completed. Export content you need before confirming deletion.
15. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, intentional misconduct, gross negligence where applicable, breach of mandatory digital-service obligations, or any other liability or consumer remedy that cannot be excluded or limited.
Subject to the previous paragraph, ArcRoute is responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care. Loss is foreseeable if it was obvious that it would happen or both parties knew it might happen when the contract was formed.
To the extent permitted by law, ArcRoute is not responsible for loss caused by your unlawful or unsafe riding, your failure to follow Section 10, incorrect information you enter, an unsupported or defective device, failure to install a notified update, or third-party networks and services outside our reasonable control, except where our own breach or lack of reasonable care contributed to the loss.
The Service is supplied for personal, non-commercial use. We are not responsible for business losses such as lost profit, revenue, opportunity, goodwill or business interruption arising from consumer use. This does not affect rights you have where local law treats you as a consumer despite a mixed-purpose use.
16. Privacy
Our Privacy Notice explains how ArcRoute processes personal data, including account information, precise location, routes, ride recordings, search activity, subscription status and website analytics. The Privacy Notice is informational and is not a blanket consent to processing.
17. Changes to these Terms
We may update these Terms for a valid reason, including changes in law, the Service, security, payment arrangements or third-party platforms. We will make the updated text available and identify its effective date. For material changes affecting an existing continuous contract, we will provide advance notice on a durable medium where required and explain any cancellation or termination right.
A change will not retroactively remove accrued rights. Where law requires express consent, continued use alone will not replace that consent. If you do not accept a material change that validly requires acceptance, you must stop using the affected Service and cancel any future renewal.
18. Governing law, courts and consumer ADR
These Terms are governed by the laws of the Czech Republic. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory consumer protection provided by the law of that country. You may bring proceedings in the courts available to you under mandatory consumer-jurisdiction rules; these Terms do not require a consumer to litigate exclusively in Prague.
We encourage you to contact support@arcroute.app first so we can try to resolve a complaint directly. Czech consumers may use the following out-of-court consumer dispute-resolution body:

Consumers in other countries may contact the consumer ADR body competent in their country where available. Participation in ADR and the binding effect of an outcome are governed by the applicable procedure and law.
19. General provisions
If a provision is invalid or unenforceable, the remaining provisions continue to apply and the invalid provision is interpreted or replaced only to the extent necessary and lawful. A delay in enforcing a right is not a waiver of that right.
You may not transfer your account or these Terms without our consent. We may transfer the Service or this contract to a successor in connection with a restructuring, sale or transfer of the business, provided that your mandatory rights are not reduced and any required notice is given.
Except for Apple’s rights under the Standard EULA, a person who is not a party to these Terms has no right to enforce them unless mandatory law provides otherwise. These Terms, the applicable Apple purchase terms and any specific offer terms presented before purchase form the agreement concerning the Service.
